It was clearly a first legal victory for the former Chairman of Ijede Local Council Development Area, Alhaji Fatiu Salisu Jimoh, at the Ikorodu High Court on Friday, March 18, as the trial judge Honourable Justice A.F. Pokanu, dismissed the case of fundamental human rights brought before him by Mr Oluwatosin Onamade for lack of merit.
The judge dismissed the application of Onamade, the owner of Western Funeral Home Limited, Ijede, wherein he sought for the enforcement of his Fundamental Rights to dignity of Human Person, Personal Liberty, Freedom of Movement and Right to Property. In its ruling, the Court said it cannot come to the applicant’s aid on the issue of fundamental human rights because the Police is basically doing its job. Noting that there was no merit to the allegation by Onomade that the Police along with Fatiu Salisu invaded his house.
Onamade, in the suit No: IKD/11531MFHR/21, sought for the protection of his Fundamental right of dignity of human person, personal liberty, freedom of movement and right to property guaranteed by section 34, 35, 39, 43 and 44 of the Constitution of the Federal Republic of Nigeria 1999 (as amended).
The judge dismissed all the prayers sought by the applicant in its entirety filed against defendants –Deputy Inspector General of Police (Force intelligence Bureau, Area 10, Garki, Abuja), DCP Eloho Okpsoziakpo (Force intelligence Bureau, Area 10, Garki, Abuja), ASP Abubarkar inwanfero (I.P.O, Force intelligence Bureau, Area 10, Garki, Abuja) and Fathiu Jimoh Salisu, former Chairman, Ijede LCDA.
He also awarded each of the Defendants N200, 000 against Onamade.
Speaking to MegaXpression Media and other Newsmen immediately after the ruling, the 4th respondent in the case, Alhaji Fatiu said the Judge has vidicated his innocence in the matter and hope other Victory for Fatiu as High Court dismisses fundamental human rights charges against Police. instituted in Federla High court, Ikoyi and Magistrate Court, Yaba, will have similar ending.
“I believe truth will always prevail, falsehood will only buy time but can never last. What we have witnessed today (Friday), I did not expect anything less our judiciary. The Judge’s ruling was nothing but the truth. I know we are not facing this case alone, another one is still at the Federal High Court, Ikoyi and Yaba, and I know the judgement will follow the same trend as today’s own,” Fatiu opined.
